The role and duties of a REC is that if supervision and administration while that of a Returning Officer is that collation, tabulation, announcement and declaration of winners of an election. Their roles are distinct and clear. Section 25 of the Electoral Act clearly enumerates those vested with the powers to make returns and the REC is not one of them
In the entire Electoral Act, a Resident Electoral Commissioner was never mentioned as a Returning Officer and so it is!
