The Supreme Court has affirmed Senator Duoye Diri’s re-election as the Governor of Bayelsa State on Friday, August 23, 2024.
The apex court dismissed the appeal of Timipre Sylva, representing the All Progressives Congress (APC) in the November 11, 2023, off-cycle election.
The panel, headed by Justice Lawal Garba, upheld the Court of Appeal’s decision of July 15, which ruled that Sylva’s appeal was an abuse of court process for filing two notices of appeal.
Justice Garba cited a section of the 1999 Constitution, stating that the APC Governorship candidate has only one right to appeal Tribunal’s judgement, not multiple appeals. This faulted Sylva, who filed two notices of appeal.
The panel, in a unanimous judgment, dismissed the appeal for lack of merit.
According to the Independent National Electoral Commission (INEC), Governor Duoye Diri of the PDP polled a total of 175,196 votes to defeat his closest rival, Timipre Sylva of the APC, who polled 110,108 votes.
